Essential Requirements in Getting Australian Business Visa

All applicants for Business Skills (Provisional) and Business visa Australia are required to sign a declaration agreeing to meet certain requirements of their visa after arrival in Australia, including:

  • You must notify the Department of Immigration and Border Protection (DIBP) of your residential address within six months of staying in Australia; and
  • You must continue to notify DIBP of any subsequent changes of your residential address within 28 days of a change of address.

There are also additional onshore requirements and obligations for the following visa holders:

  • Business Owner;
  • State/Territory Sponsored Business Owner;
  • Senior Executive Visa holders; and
  • State/Territory Sponsored Senior Executive Visa holders.

Within the first 24 months of entry in Australia, business visa holders must continue providing input into the economy of Australia by becoming involved as owners or part owners of any senior level businesses.

 

The business must do at least one of the following:

  • Has business links to other countries;
  • Increase employment in Australia;
  • Exports any type of Australian goods and services;
  • Import goods that are also produced;
  • Introduce new or improved technology; or
  • Add to commercial activity and competitiveness within sectors of the Australian economy.
 

Provisional Business Visa Holders

Provisional Business Visa applicants must in addition:
  • Qualified owner by having a business with qualities mentioned above; and
  • Actively manage in the day-to-day management of that business; and
  • Continue to make such genuine efforts to hold substantial ownership interest and participate at a senior level in the day-to-day management of such a business.
Business Talent Visa Holders

You are required to meet the criteria above together within three years after arrival in Australia if you hold a business talent Visa. Visa cancellation is automatically noted if you fail to do so.

Investor Visa Holders

For investor visa holders, one must maintain their investment for a 4-year term. Failure to do so may result in visa cancellation.
